Terms & Conditions

Order Submission & Confirmation

- Placing an order and completing payment on our website constitutes a binding sales contract under U.S. contract law, with additional compliance obligations for baby products per CPSC and FDA regulations.
- For customized baby bottles (e.g., engraved, personalized labels), we will send a design confirmation email with mockups and safety disclaimers within 1 business day of your order. Production will only begin after we receive your written approval, and all customized items undergo additional CPSC compliance checks.
- We reserve the right to cancel orders in the following cases:
- Insufficient inventory or product discontinuation, especially for items subject to CPSC safety updates.
- Pricing errors due to website technical issues.
- Invalid or incomplete shipping/billing information, which may delay delivery of time-sensitive baby products.
- Suspected fraudulent transactions (e.g., stolen credit cards) to protect our customers and maintain safety compliance.
- Failure to confirm customization details within 7 business days (to avoid delays for baby care needs).
- Cancelled orders will be fully refunded within 3 business days. For customized orders cancelled after production has started, a 20% production fee will be deducted from the refund, covering safety inspection costs.

Product Information & Liability

- Product descriptions, specifications (e.g., bottle material, diaper absorbency, wipe ingredients), and images are for reference only, but we ensure all products meet CPSC and FDA standards (e.g., lead-free materials, non-toxic wipes, anti-choking bottle nipples). Minor variations (e.g., color shades due to screen display) are not considered defects.
- We are not liable for dissatisfaction caused by personal preferences (e.g., bottle flow rate not suiting baby’s feeding style, diaper fit not matching baby’s body type) or incorrect size/type selection. We recommend reviewing product details and customer feedback before purchase.
- We are not responsible for damages or injuries caused by improper use (e.g., using bottles beyond recommended age, not following wipe usage instructions, improper diaper fitting) or unauthorized modifications (e.g., altering bottle nipples).
- All baby products are designed for infant use per CPSC age guidelines; we are not liable for use outside of recommended age ranges or for non-baby purposes.

User Obligations

- Provide true, accurate, and complete information when placing an order (including baby age, sensitive skin details, and delivery instructions). You are responsible for delivery delays or failures caused by incorrect information.
- Do not resell our products for commercial purposes without our prior written authorization (except for authorized retailers with a wholesale agreement and CPSC compliance certification).
- Comply with all U.S. safety laws and regulations when using our products (e.g., following bottle sterilization guidelines, disposing of used diapers properly, discontinuing use if a product is recalled by CPSC).
- Refrain from fraudulent activities (e.g., false defect claims, returning used products as new). We reserve the right to refuse service to customers who violate these policies, especially to protect infant safety.

Intellectual Property Rights

- All content on our website (product images, descriptions, logos, baby bottle designs, safety guides) is protected by U.S. copyright and trademark laws and is owned by Baby Care Essentials USA or its authorized licensors.
- You may download or save website content for personal non-commercial use only. Unauthorized copying, modification, distribution, or reproduction of any content for commercial purposes is strictly prohibited and may result in legal action.

Limitation of Liability

- To the maximum extent permitted by U.S. law, we shall not be liable for indirect, incidental, or consequential damages (e.g., inconvenience, baby discomfort, additional costs due to delayed delivery) arising from the purchase or use of our products, provided the products meet CPSC/FDA safety and quality standards.
- Our total liability for direct damages (e.g., defective products causing harm) shall not exceed the purchase price of the affected item, except in cases of willful misconduct or gross negligence in safety compliance.
- We are not liable for order delays or failures caused by force majeure events (e.g., natural disasters, supply chain disruptions, CPSC-mandated product recalls, shipping carrier strikes) beyond our reasonable control. In such cases, we will offer affected customers the option of a refund, exchange, or order modification.

Dispute Resolution

- Any disputes arising from the purchase or use of our products shall first be resolved through friendly negotiation between you and our customer service team, with priority given to resolving safety-related issues promptly.
- If negotiation fails, either party may initiate legal proceedings in the state or federal courts located in Cook County, Illinois, USA.
- These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Illinois, USA, without regard to its conflict of law principles, and shall comply with federal CPSC and FDA regulations.
